App Terms of Use

1. Scope and provider

These terms of use govern the use of the mobile application "PROG" (the "App"). The App is provided by Levin Köhler, sole proprietor, Talstr. 13/1, 74579 Fichtenau, Germany ("we" or "provider"). By installing and using the App, you agree to these terms of use.

2. Description of service

PROG is an all-in-one app for personal growth covering journaling, habit tracking, task organization (organizer), and microlearning. Details on data processing can be found in the App Privacy Policy.

3. No account, local storage

Using the App does not require registration. All content (journal entries, habits, tasks, learning progress) is stored exclusively locally on your device. We take no responsibility for loss of content due to uninstallation, switching devices, or device failure without your own backup.

4. Subscriptions and pricing

Certain features of PROG are paid and available as a subscription or one-time purchase:

• Annual plan: €39.99 per year
• Monthly plan: €5.99 per month
• Lifetime access (one-time payment): €69.99

Prices include applicable statutory VAT and may vary by country or store. Purchases and billing are processed exclusively through the respective app store (Apple App Store or Google Play Store); their own payment and usage terms apply in addition to these.

5. Auto-renewal and cancellation

Subscriptions renew automatically for the selected period unless cancelled at least 24 hours before the end of the current period. Cancellation happens directly through your app store account settings (Apple ID or Google account) – not through the App itself or directly with us.

6. Right of withdrawal

Consumers generally have a 14-day right of withdrawal for distance contracts involving digital content. This right ends early if you have expressly consented to immediate performance of the contract and confirmed that you thereby lose your right of withdrawal – this typically happens during the respective app store's checkout process. For refunds, please contact Apple or Google support directly, since payment processing takes place there.

7. License to use

We grant you a simple, non-transferable, non-sublicensable right to use the App for personal, non-commercial purposes on devices you control. All rights to the App (software, design, content, trademarks) remain with us or our licensors.

8. Your content

Content you create in the App (e.g. journal entries) belongs to you. Since it is stored exclusively locally on your device, we have no access to it and take no responsibility for backing it up.

9. Usage restrictions

You agree not to reverse engineer, decompile, tamper with, or use the App for unlawful purposes.

10. Disclaimer

PROG supports personal growth and does not constitute medical, psychological, or therapeutic advice. For health or mental health concerns, please consult a qualified professional. We do not guarantee uninterrupted availability of the App.

11. Limitation of liability

We are liable without limitation for intent and gross negligence, and under applicable product liability law. For ordinary negligence, we are liable only for breach of material contractual obligations, limited to foreseeable, contract-typical damage.

12. Use by minors

Individuals under 18 need consent from a parent or legal guardian to use the App, and in particular to enter into paid subscriptions.

13. Changes to these terms

We may update these terms of use, for example when App features or legal requirements change. Where possible, we will notify you of material changes within the App.

14. Governing law and jurisdiction

These terms are governed by German law, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection provisions of your country of habitual residence remain unaffected.
